A Cape Coast High Court annulled the 2020 Parliamentary Election for the Assin North Constituency on Wednesday, July 28, 2021.

The Minority leader in Parliament, Hon. Haruna Iddrisu has communicated his side’s decision to appeal against the ruling of the Cape Coast High Court earlier today, that annulled the 2020 Parliamentary Election for the  Assin North Constituency.

He made this known at a press conference in Parliament monitored by Dennislaw News on Wednesday, July 28, 2021. He bemoaned the use of Courts to tilt the balance of power in the Legislature.

“We in the Minority remain unshaken, we are confident that is our seat and will remain our seat, and we will contest the ruling. The judge erred both in law and in fact. It is a travesty of justice but what is worrying, we don’t want to believe that the courts of Ghana have been captured and that the courts of Ghana have become forums being used surreptitiously to tilt the balance of power,” he said.

“We are equal, 137-137. What is happening is the courts are now being used to tilt the balance of power and to weaken the time-tested historical notion of checks and balances. Justice must not only be done but must be manifestly and undoubtedly be seen to be done,” he added.

The Court presided by Justice Kwasi-Boakye perpetually restrained James Gyakye Quayson from holding himself as the MP for the Assin North Constituency.

Moreover, the court upheld the petitioner’s prayer that the election of Hon. Quayson was in contravention of Act 94(2) and Section 92(A) of the Representation of People’s Act(PNDCL 284).

The Judge further ruled that the subsequent clearance by the EC for James Gyakye to contest in the 2020 parliamentary elections was illegal, void, and of no effect.

The presiding Judge, therefore, called for a fresh Parliamentary election for the Assin North Constituency.
