Supreme Court dismisses Quayson's review application

The Supreme Court has dismissed a review application by the Member of Parliament for Assin North, James Gyakye Quayson.

The MP per this application filed on June 29, had sought to overturn the May 17 judgment of the apex court which ordered Parliament to expunge his name from their records. 

Moving the application today, Tsatsu Tsikata who is counsel for the MP noted that the ordinary bench misrepresented the decision in Asare v AG by applying only the opinion of Atuguba(JSC) which according to him, was a separate opinion.

Additionally, he maintained that per Article 97(1)(e) of the 1992 Constitution, the ordinary panel, in the opinion of Amegatcher JSC made a per incuriam decision.

Moreover, he indicated that by ordering the name of his client to be expunged, the Court erred by not giving him a hearing.

On his part, the AG, Godfred Dame faulted Mr Tsikata for his assertion that the court made a misrepresentation.

He thus noted that the apex court per Articles 129 and 2(2) of the Constitution had powers to take any view and make any decision in any matter whatsoever.

Mr Dame altogether opposed the application and asked the Court to strike it out because no exceptional circumstance had been raised.

Mr Frank Davis, who also opposed the application, took turns to explain why the applicant's lawyer had “disingeniously” misrepresented the court per Asare v AG and also expressed concern about the attempt to “discredit” Amegatcher(JSC) per his opinion in the substantive judgment.

In its ruling, the nine-member panel presided over by the Chief Justice held that Gyakye Quayson's 17 ground review application was without merit and dismissed same.

Other members of the panel were Lovelace-Johnson (JSC), Owusu (JSC), Kulendi (JSC), Mensa-Bonsu (JSC) Asiedu(JSC), Ackah-Yensu (JSC), Gaewu (JSC) and Koomson (JSC).
