Supreme Court adjourns Assin-North MP’s appeal to Feb. 10

When the court sat yesterday, February 8, the MP’s lawyer, Mr. Tsatsu Tsikata told the court that even though he received the affidavit on February 3, he is expected to respond in seven days according to rule 64 (2) of the Supreme Court rules and CI 16.

The Supreme Court has adjourned to February 10, 2022, a motion filed by the Assin-North Member of Parliament James Gyekye Quayson, where he is seeking to quash the decision of the Court of Appeal relative to the interpretation of Article 94 (2a) of the 1992 Constitution.

The MP initiated this action in January this year to invoke the Supervisory Jurisdiction of the apex Court on whether or not a legal argument could be made before any reference of a constitutional question could be made to the Supreme Court.

When the court sat yesterday, February 8, the MP’s lawyer, Mr. Tsatsu Tsikata told the court that even though he received the affidavit on February 3, he is expected to respond in seven days according to rule 64 (2) of the Supreme Court rules and CI 16.

He further stated that some documents they received from the Court of Appeal had errors that needed correction.

The Court is expected to hear a response from Mr. Quayson’s lawyer to the affidavit filed in opposition by the respondent’s lawyers when it resumes on the adjournment date.
