Supreme Court: James Quayson's motion for full disclosures by AG dismissed

The Supreme Court has dismissed a judicial review application filed by the Assin-North MP, James Gyakye Quayson against the High Court sitting on his criminal case.

Quayson had sought to quash a ruling by the High Court which denied his application for the Attorney General to make full disclosures.

The MP, through his counsel, argued that the High Court erred by admitting a reply letter by the AG in response to his application without it being placed under oath.

He thus averred that this decision by the court was in error since that letter had not been admitted in evidence.

The MP at the time had filed an application at the High Court seeking an order from the court for full disclosures by the AG.

The AG in his response, wrote a letter to the court, which the court accepted per its ruling of dismissal of the application thus prompting this application.

In his response, the Attorney General, Godfred Dame argued that the applicant was given a hearing despite his averment.

He thus noted that the court, per its ruling did not err and thus the application did not raise any error patent on the High Court's decision.

In its ruling, the Chief Justice, Gertrude Torkornoo made a finding that the applicant was duly given a hearing by the High Court.

The court also heard that the ruling of the High Court was made within its jurisdiction thus dismissing the motion.
