The Ghana Bar Association(GBA) has directed all members to desist from the practice of signing processes and letters to court in the name of their law firms instead of their names.
It notes that such a practice is contrary to Section 2 of the Legal Professions Act, 1960(Act 32), Order 82 Rule 3 of the High Court (Civil Procedure) Rules, 2004 (C.I. 47) as well as case law and thus calling on all lawyers to desist from the same.
A notice signed by Kwaku Gyau Baffour, National Secretary of the Association indicates that the directive applies to the signing of documents such as; Request of Court proceedings, Letters to Registrars, Letters to Her Ladyship the Chief Justice, Letters to the Judicial Secretary and all administrators.
Additionally, the notice emphasizes an order made by the Chief Justice in this regard and reminds all that any such document delivered in breach of this directive will not be recognized by the Judicial Service.
