The Supreme Court has set February 15, 2022 to hear a review application filed by lawyers of Assin-North Member of Parliament, James Gyekye Quayson, in which they are challenging the timeline given for filing their response to an affidavit filed by interested parties in his appeal case before the Court.

Lawyer for the MP, Mr Tsatsu Tsikata, argued that the Supreme Court breached the rules of court by hearing the application last Tuesday.

According to him, one of the interested parties had filed a response to the application and per the rules of the Supreme Court, his client had seven days to file a reply to the response filed by the interested party.

He stated that the seven days had not elapsed and therefore the Supreme Court should not have heard the case last Tuesday.

“In view of this application, this court is unable to hear the matter,” the five member panel presided over by Justice Gabriel Pwamang, ruled.

The Court has further adjourned the hearing of the original appeal to February 22, 2022.

Background

Mr. James Gyekye Quayson filed an appeal at the Supreme Court, seeking to quash the decision of the Court of Appeal relative to the interpretation of Article 94 (2a) of the 1992 Constitution.
