SC on Feb 8, 2022: Assin North MP case on the bill

The applicant, Michael Ankomah-Nimfah has filed a writ seeking the interpretation of Article 94 (2a) and injunction of the Member of Parliament from holding himself as such.

Among the host of cases to receive the Supreme Court’s attention this week, are two particular cases against the embattled Assin North MP, Hon. James Gyakye Quayson.

The applicant, Michael Ankomah-Nimfah has filed a writ seeking the interpretation of Article 94 (2a) and injunction of the Member of Parliament from holding himself as such.

On February 1, 2022, however, the Supreme Court could not sit on the matter due to the unsuccessful attempts made by the Registrar to serve the MP.

As a result, the Supreme Court panel presided over by Justice Jones Dotse and comprised Nene Amegatcher, Gertrude Torkonor, Yoni Kulendi, Agnes Dordzi, Mariama Owusu and Prof. Henrietta Mensa-Bonsu ordered the applicant to aid the Registrar to serve the defendant in his personal capacity but not as an MP.

Further to the above, a motion by the Assin North Mp, James Gyekye Quayson to quash the decision of the Court of Appeal relative to the interpretation of Article 94 (2a) of the 1992 Constitution will be heard on Tuesday, February 8, 2022,.

The MP initiated this action in January this year to invoke the Supervisory Jurisdiction of the apex Court on whether or not a legal argument could be made before any reference of a constitutional question could be made to the Supreme Court.

However, it is worth mentioning that a Constitutional law action filed in July 2021 at the Supreme Court by a resident of Assin North, is still pending at the Highest Court of the land.

The applicant in this case is seeking an interpretation of Article 94(2)(a) of the 1992 Constitution, which borders on the disqualification of an MP who holds allegiance to a country other than Ghana.
