Restrain Tullow from violating Local content Regulation: GOGSPA seeks court injunction

According to the Writ of Summons, the plaintiff is praying the court for an order of interlocutory injunction against Tullow, its agents, assigns, etc. from violating the Local Content and Local Participation (Amendment) Regulations 2021(LI 2435) pertaining to the award of petroleum contracts in Ghana.

The Ghana Oil and Gas Providers Association has filed a suit at the High Court (Commercial Division) against Tullow Ghana Limited seeking an interlocutory injunction against the latter.

According to the Writ of Summons, the plaintiff is praying the court for an order of interlocutory injunction against Tullow, its agents, assigns, etc. from violating the Local Content and Local Participation (Amendment) Regulations 2021(LI 2435) pertaining to the award of petroleum contracts in Ghana.

The plaintiff notes that before this decision, it had made several complaints to Tullow relative to its award of services in the Oil and Gas upstream Sector to foreign Venture Companies in contravention of the Regulation.

It adds that it highlighted and reminded Tullow per its June 2022 petition of the fact that any such awards to Foreign Venture Companies after February 2022 were in violation of the Law however the defendant has maintained its position.

GOGSPA, therefore, avers that the above behavior of Tullow could cause mass unemployment among skilled Ghanaians in the oil and Gas mainstream sector if not restrained by the court.

They are therefore praying to the court for inter alia;

A declaration that the award of petroleum contracts for the provision of goods and services which is reserved for indigenes Companies to Joint Venture Companies in Ghana is illegal.

A further declaration that the award of such contracts which according to the Local Content and Local Participation Regulations (LI 2204) as amended by (LI2435) are reserved for indigenous Companies to joint venture companies is null and void.

Also, the plaintiff seeks an order directed at Tullow to cancel any of such contracts awarded to joint venture companies contrary to the Regulation.

However, when the case was first called, the parties were advised by the court to resort to an amicable resolution of the matter.

The case has meanwhile been adjourned to October 10, 2022, for the hearing on the motion filed.
