Phar Rangers Football Club appeals its 5-year ban by the GFA

Phar Rangers Football Club, a Division one league club in Ghana has appealed the 5-year ban of the Disciplinary Committee of the Ghana Football Association(GFA) on the club and its directors.

According to the notice of Appeal, the club notes that the decision of the Disciplinary Committee of the Ghana Football Association against its directors is void on grounds of breach of the rules of natural justice thus a violation of audi alteram partem rule.

Furthermore, the club avers that the decision of the Disciplinary Committee of the GFA against the club’s shareholders is void on grounds of breach of the rules of natural justice.

Thirdly, they argue that the decision of the Disciplinary Committee of the Ghana Football Association against the club, Phar Rangers FC is void as no hearing was conducted contrary to the rules of fair trial or hearing.

Also, they contend that the decision of the Disciplinary Committee of the GFA is ultra vires and as such it is void ab initio.

Next, the club deems the decision of the Disciplinary Committee of the GFA against its shareholders as ultra vires, and as such it is void ab initio as a Disciplinary Committee has no jurisdiction over shareholder qua shareholder of a football club.

That the decision of the Disciplinary Committee of the GFA is against the weight of the evidence adduced.

Finally, they note that the decision of the Disciplinary Committee of the GFA is harsh, excessive, and contrary to law.

Phar Rangers FC was charged for misconduct by the Ghana FA after it withdrew from all competitions from the association, forcing the Ghana FA to activate regulations on the club’s withdrawal with immediate effect.

The Disciplinary Committee has found the club guilty of the charges and will now cease to exist for the next five years.

“That Phar Rangers FC is hereby suspended from all competitions of the Ghana  Football Association for a period of five (5) years effective this 2020/2021  football season in accordance with Article 13(3) of the Division One League.

Consequently, the Ghana FA ordered the players of the team to apply and granted free agent status following Wednesday’s ruling.

“That having suspended Phar Rangers FC from all competitions of the GFA, the  Disciplinary Committee hereby furthers orders that the players of the club shall  apply and shall be granted free-agent status by the Players’ Status Committee of the GFA, free all encumbrances to save the conditions attached to the transfers from their previous clubs to Phar Rangers FC.
