NDC lawyer confident in appeal against Cape Coast judgment on Assin North election
According to Mr. Tamakloe, the NDC has sufficient reasons to challenge the court’s ruling, adding that a refusal to do so would set a bad precedent for the country’s democracy.
The NDC has expressed confidence in its decision to appeal against the Cape Coast High Court ruling that annulled the December 2020 parliamentary election in the Assin North constituency. This is according to one of the leading members of the NDC’s legal team, Godwin Edudzi Tamakloe.
According to Mr. Tamakloe, the NDC has sufficient reasons to challenge the court’s ruling, adding that a refusal to do so would set a bad precedent for the country’s democracy.
Speaking on Accra-based Citi News, Mr. Tamakloe indicated that the NDC’s grounds of appeal wield significant merit and that is what would most likely ensure that the Appeals Court rules in favor of Mr. James Quayson.
“The filing of that notice of appeal is the clearest demonstration of how vehemently we disagree with that judgment. And so for us, we believe that the grounds of the appeal that we have formulated have the real likelihood of getting this judgment set aside for us. The danger with allowing this judgment to hold in our statues books is that it will manifest injustice against other people,” he said.
The notice of appeal was filed on Monday, August 2, 2021, at the Court of Appeal, Cape Coast, in which Mr. Quayson averred that the judgment delivered by Justice Kwasi Boakye was neither based on law nor in fact.
Mr. Tamakloe further hinted that the NDC will file a stay of execution on the court’s order instructing Mr. Quayson to not hold himself as MP for the Assin South constituency until the appeal is finally determined.
“Just wait for what will be done within this period… We have appealed the judgment. You don’t stay [the execution] before filing a notice of appeal. The notice was only filed on Monday,” he stated.
