Motion against High Court: Gyakye Quayson seeks review of SC ruling

Lawyers for the embattled Assin North MP, James Gyakye Quayson have filed a motion for a review of the Supreme Court ruling on certiorari application against the High Court.

On November 30, 2022, the Supreme Court panel presided over by Dotse(JSC) in dismissing the motion noted among others that the ' motion for Certiorari and Prohibition against the July 12, 2022 decision of the High Court(Criminal Division) fails.'

Mr. Gyakye Quayson is facing five counts of perjury and forgery of a passport at the High Court.

During the testimony of the First Prosecuting witness, Richard Takyi-Mensah, Mr. Tsikata, the lawyer for the MP, objected to the tendering of his witness statement.

This was however overruled by the trial judge, Justice Mary Maame Ekue who thus admitted the witness statements and paragraphs.

Being dissatisfied with this, the MP invoked the supervisory jurisdiction of the supreme court seeking firstly to quash the above decision and an order of Prohibition against the same.

On Wednesday, January 18, 2022, when the case was called, counsel for the applicant, Mr. Tsatsu Tsikata asked for time to enable his side to file additional grounds to their case due to the delay in receiving the court’s full ruling on the motion.

On her part, the Director of Public Prosecutions, Mrs. Yvonne Atakora Obuobisa also noted that her side wants time to file its Statement of Case per their late receipt of the ruling.

Consequently, the court directed the applicant and respondent to file their additional grounds and responses by February 15 and 22 respectively.

The case has meanwhile been adjourned to March 1, 2023, for a hearing.
