Major Mahama murder trial :Court overrules "Submission of no Case”

The High Court (Criminal Division) has ordered the 14 accused persons in the Major Mahama trial to open their defense.

This order was made after the court presided over by Justice Mariama Owusu JSC overruled a submission of no case filed by William Baah, the Assemblyman for Denkyira Obuasi, and the 13 others.

William Baah has pleaded not guilty to the charge of abetment while the others have also denied their respective charges of conspiracy and murder.

In her ruling on the motion on July 4, 2022, the presiding judge noted that a prima facie case has been established by the prosecution.

She noted therefore that the accused intentionally caused harm to the deceased Major thus dismissing the motion of Submission of no case and ordering the accused persons to open their defense.

The prosecution has so far called 14 witnesses and duly closed its case.

The 14 accused persons; William Baah, Bernard Asamoah, Kofi Nyame, Akwasi Boah, Kwame Tuffour, Joseph Appiah Kubi, Michael Anim, Bismarck Donkor.,John Bosie, Akwasi Baah, Charles Kwaning, Emmanuel Badu, Bismarck Abanga, and Kwadwo Anima are alleged to have played respective roles contributing to the lynching of Major Maxwell Mahama on May 29, 2017, at Denkyia Obuasi in the Central Region of Ghana.
