India: Court grants bail to mother allegedly involved in selling her child

The matter pertains to the issue of selling of a child to a couple by the child's mother through other co-accused.

A Delhi Court recently allowed bail to a mother of an infant child along with other co-accused who was allegedly sold by her through co-accused persons to other accused persons.

Metropolitan Magistrate Vivek Kumar Agarwal, Saket District Court opined, "Offence in question is certainly heinous, as the child in question was treated as property. Certainly, the mother of the child has committed an act, which is against the pious and celebrated concept of motherhood in Indian Society."

However, noting that the investigation regarding the accused mother had already been completed, Court held that no purpose would be served to detain her behind the bars and therefore, granted her bail. 

The matter pertains to the issue of selling of a child to a couple by the child's mother through other co-accused. However, it has been argued by the accused parties that the child was not sold but rather given for adoption by child's mother, Neetu.

The mother filed the bail application through Advocate Hemant Mishra stating that she had been falsely implicated in the case and she herself had called the women's helpline and complained against the co-accused in the matter.

In addition to this, it was further submitted that she was first planning to abort the pregnancy, however, the same was condemned by her family members and later, the co-accused Sonia Gupta & Vineet Pal suggested that she should give up her child for adoption.

It was further argued that after 6 months when Neetu requested to meet her child, the co-accused threatened her that if she does not stops her demands of meeting with her child they will incriminate her in false cases as they have signed documents from her.

Court while allowing bail to the mother noted, "The child who has been recovered has been lying unattended by his mother for last several days. Undoubtedly, mother is the best person to look after the infant. The accused Neetu is in JC (Judicial Custody) for last several days. Investigation qua said accused already been completed and no purpose would be served to detain her behind the bars."
