High Court remands purported son of Aisha Huang, one other to Nsawam Prison over immigration offences

The Accra High Court (Criminal Division 5) has remanded Huang Lei, purported to be the son of ‘Galamsey Queen’ Aisha Huang, and one other Chinese national, Huang Haihua to the Nsawam Medium Security Prison for immigration offences. 

The two are standing trial over the expiration of resident permits, contrary to Section 20(1) and 52(1)(D) of the Immigration Act, 2000 (Act 573); possession of ammunition without lawful authority contrary to section 11 of the arms and ammunitions Act, 1972, NCD 9, and possession of a forged official document contrary to section 166 of the criminal and other Offences Act, 1960, Act 29.  

According to a DailyGuide report on November 23, the duo were arrested on September 2, 2022, at Kumasi by personnel of the Security Council Secretariat, and the Ghana Immigration Service. 

“A search conducted in the room of the first accused person (Huang Lei) revealed among other things, eight (8) packs of Eley shotgun cartridges, containing about two hundred and fifty (250) pieces of ammunition. He was not able to provide a valid licence for them,” Watkins Adama, a State Attorney said in court on Thursday. 

The accused persons have however pleaded not guilty, and their lawyer, Frank Kumakoh said his side would soon be presenting an official bail application before the court. He 

While giving its ruling, the court presided over by Justice Lydia Osei Marfo noted that since the accused persons were foreigners, who also did not have sufficient social and economic ties within the jurisdiction, they were of high flight risk, and thus remanded them to prison custody. 

In addition, the court directed both parties to file disclosures before the next adjournment date on December 13, 2022, for case management conference.
