GPGC Scandal: CID petitioned to investigate Boakye Agyarko, Gloria Akufo, Godfred Dame

The Alliance for Social Equity and Public Accountability (ASEPA) has petitioned the Criminal Investigations Department of the Ghana Police Service to investigate “three Government officials whose actions and inactions resulted in the recent GPGC arbitration that slapped Ghana with a $170million judgment.”

A statement sighted by Dennislaw News reveals that the three persons are the former Energy Minister, Mr. Boakye Agyarko, the former Attorney General, Mrs. Gloria Akufo, and Mr. Godfred Dame, the Attorney-General.

Mr. Agyarko is cited for terminating the contract “based on an alleged review committee report which was exposed to be false during the arbitration by the International Court.”

Mrs. Gloria Akufo is accused of failing to “honor the obligations of the State under the termination clause of the agreement” and for relenting on “her fiduciary responsibility to the State by failing to reach a reasonable settlement with GPGC which would have cost the nation far less.”

The case against Mr. Godfred Dame is that he “negligently failed to meet an appeal window that was made available to the State after the initial arbitration.”

The civil society group noted its suspicion that the three officials “conspired to deliberately cancel a very important Power Purchase Agreement when they were fully aware that the Company has invested heavily into the project, then failed to settle the Company even though their contract was illegally terminated and they knew very well that under the termination clause, the company had a genuine claim.”

The petitioners further allege that the accused persons deliberately failed to meet the deadline for appeal after the initial judgment was delivered. According to them, this was “just to accrue this avoidable judgment debt to GPGC and possibly benefit from the money the state would pay to GPGC.”

ASEPA has further indicated its ability to assist the police in the investigations as well as “make any document the Police may require … for an effective investigation.”
