Full Text: CHRAJ's report on Paul Adom Otchere, Airport Company christmas trees saga

Adom Otchere according to CHRAJ had previously failed to submit a response and accompanying documents on the matter. But upon a subpoena, he did so, insisting on the non-applicability of the procurement law in the process.

The Commission on Human Rights and Administrative Justice (CHRAJ) has released its report following the petition by a journalist, asking it to investigate and surcharge Paul Adom-Otchere, the Board Chairman of the Ghana Airport Company Limited (GACL) for procurement breaches in the renting of Christmas trees and lightening decorations worth GH₵ 128,000 in 2021. 

In the petition, the journalist, Mr. Amenga-Etego argued that Paul Adom-Otchere, failed to invite at least three vendors to submit bids for the procurement of the Christmas trees, that the total value of the decorations is above the threshold of requesting for quotations from vendors and that the call for bids ought to have been advertised in newspapers, as according to the Public Procurement Act, Act 663.

Adom Otchere according to CHRAJ had previously failed to submit a response and accompanying documents on the matter.  But upon a subpoena, he did so, further stating that GACL did not “procure” the decorations mentioned of as defined by the Procurement Act 2003 (Act 663) but that it instead “rented” them, and thus insisting that there was the non-applicability of the procurement law in the process. 

CHRAJ in its findings said Adom Otchere partly interfered in the procurement of the Christmas inspirations by making demands for invoices. It also observed that the management of GACL has not been applying provisions of Act 663 in the renting of Christmas trees and decorations. 

“We think this is an anomaly and ought to cease forthwith. We have noted failure to define procurement under the Act may have accounted for this," the report said.
