Dismissed Circuit Court judge sues Judicial Service, Chief Justice, says removal from office unlawful

The Jasikan Circuit Court judge, Mr. Alfred Kwabena Asiedu who was sacked for improper conduct in a divorce case has filed an application for Judicial Review against his dismissal. 

In his application filed at the High Court (Human Rights Division), Mr. Asiedu is seeking a declaration that his removal from office as a Circuit Court judge is unlawful. 

He also wants the court to declare that both the Disciplinary Committee and the Judicial Council acted "untra virus when they made findings of malicious prosecution against him.

“And a further declaration that the said findings of the two bodies are patent error of law on the face of the record and same liable to be quashed by the supervisory powers of this court," the application said. 

In the November 13, 2023 letter from Chief Justice Gertrude Torkornoo announcing his dismissal, Mr. Asiedu was found to have been involved in an improper relationship with one Singari Diana Sadia, who had a Divorce case pending before his court.

The Judicial Service Disciplinary Committee further found that he caused the arrest and prosecution of  Ms. Singari Diana Sadia without justification and subsequently recommended his dismissal in accordance with article 151 (1) of the 1992 Constitution. 

Mr. Aseidu had previously denied wrongdoing, stating further that the allegations against him were a “figment of the petitioner’s illusioned imagination.”

In his motion for Judicial review, the Judicial Service is listed as the first respondent, the Chief Justice second respondent, and the Attorney-General, as the third respondent.
