The Nungua Traditional Council is calling on all homeowners on Adjiriganor/Borteyman lands to regularize their documents.

At a press conference, the Paramount Chief of the Area, Professor Oboade Notse King Odaifio Welentsi III noted that his outfit was ready to enforce the judgment of the Supreme Court which pronounced them the rightful owners of the 456.25 acres of land.

“Homeowners on the land are being called upon to approach the Nungua Stool, pay homage person­ally first to be known as subjects by the King and to regularise their documents and to have an extension of the lease covering their properties on the land to legitimize their peaceful stay and to secure their properties as well,” he noted.

The Supreme Court per its judgment dated 16th December 2020 in the case involving inter alia Empire Builders, Ernesto Taricone, Topkings Enterprise Limited, and the Nungua Stool, conclusively adjudged that Empire Builders, the developers of the estate aforementioned, at all material times acquired no form of interest in any land from the Nungua Stool.

Background

According to the affidavit, Top Kings Enterprise Ltd, a real estate company that does business for and on behalf of the stool, commenced real estate development on land it had acquired from the Nungua stool at Adjiriganor/Borteyman Sometime in 1998.

Empire Builders Limited instituted action against Top Kings at the High Court in suit No. L49/99 entitled Empire Builders Limited vs. Top Kings Enterprise Limited. and secured an order of Interim Injunction to restrain Top Kings from developing the land.

The case traveled to the Supreme Court for 22 years with all the courts dismissing Empire Builders Limited's claims to the land.

After winning the case per the Supreme Court judgment on December 16, 2020, Top Kings decided to return to its land to develop the same.

Following this, Empire Builders Ltd commenced new action at the High Courts in Accra and Adenta in 2021 to stop Top Kings and its assigns from developing the land arguing that it was not covered by the Supreme Court judgment.

However, both cases at the Accra and Adenta High Courts were dismissed basically because they constitute an abuse of the court process because of the Supreme Court judgment including a further appeal by Empire Builders Ltd to the Court of Appeal.
