Causing financial loss: Be circumspect of seemingly harmless actions or omissions-Justice Brobbey

Speaking on the topic “Ingredients of the law of causing financial loss to the state,” at a two-day training workshop organized by the Centre for Practical and Multidisciplinary Legal Education and Training (CPMLET), UPSA, Justice Brobbey noted that the law on causing financial laws is intended to deter public officials whose spending decisions could get them into conflict with the law.

A retired Supreme Court Judge and former Chief Justice of the Republic of Gambia, Justice Stephen Brobbey has cautioned managers of public funds to be circumspect while discharging their duties.

According to him, such officials ought to refrain from commissions and omissions that may seem harmless but have the propensity to dent their hard-built legacies in those offices.

Speaking on the topic “Ingredients of the law of causing financial loss to the state,” at a two-day training workshop organized by the Centre for Practical and Multidisciplinary Legal Education and Training (CPMLET), UPSA, Justice Brobbey noted that the law on causing financial laws is intended to deter public officials whose spending decisions could get them into conflict with the law.

Furthermore, he highlighted the fact that the law encapsulates actions and omissions.

Moreover, the venerable Justice indicated that the law of causing the financial loss is no respecter of persons thus urged public officials to adhere to due processes in taking actions.

He added that irrespective of the good plans and intentions of a public officer if the due process like adhering to the procurement laws in the procurement of goods and services is not done, officials may find themselves in trouble.

Therefore he urged officials to be careful of actions and omissions that may seem harmless because they can get those officials into trouble.

In all, about 60 participants made up of procurement officers, principals of colleges and heads of institutions attended the workshop.
