Barker-Vormawor enters conditional appearance in GHC10 M defamation suit by Kan Dapaah

This follows several reports in the media about the plaintiff’s quest to seek an order for substituted service owing to the difficulty in reaching Oliver for service.

Convenener for the #FixTheCountry Movement, Oliver Barker-Vormawor has today a conditional appearance in the GHC10 million defamation suit filed against him by the National Security Minister, Albert Kan Dapaah.

This follows several reports in the media about the plaintiff’s quest to seek an order for substituted service owing to the difficulty in reaching Oliver for service.

Oliver is however on record to have denied the above allegation insisting that no one had reached out to him for service.

According to Order 9 Rule 7 of C.I. 47;

(1) A defendant may file a conditional appearance. 

(2) A conditional appearance, except by a person sued as a partner of a firm in the name of that firm and served as a partner, is to be treated for all purposes as unconditional appearance unless the defendant applies to the Court within the time limited for the purpose, for an order under rule 8 and the Court makes an order under that rule.

In September this year, the National Security Minister sued Oliver Barker-Vormawor, over allegations that the minister and other government officials tried to bribe him (Vormawor) to stop his activism.

Mr. Vormawor, who's also the Executive Director of the Democratic Accountability Lab, organizers of the recent #OccupyJulorbiHouse protest, had stated on September 22 that he was offered $ 1 million and juicy government appointments to forfeit his activism - a claim he says is backed by evidence.  

However, in the suit, the Minister maintains that the allegations by Mr. Vormawor are defamatory and is thus seeking GHC10,000,000.00 in damages.

He is also seeking an apology for and retraction of the words complained of as well as “a perpetual injunction restraining the Defendant from repeating similar or other defamatory words against the Plaintiff.”
