Ambulance case: AG to discontinue charges against 2nd accused

The Attorney-General has told an Accra High Court that he intends to file a nolle prosequi to discontinue charges against former Chief Director at the Ministry of Health, Dr. Sylvester Anemana in the ongoing ambulance case.

Dr. Anemana who is the second accused person is currently out of the country for medical reasons. 

The decision came after Dr. Anemana's wife, attending the court session remotely from India where her husband is undergoing kidney transplant surgery, stated that he was unable to communicate due to being in the operating theatre.

Just as the presiding Judge, Justice Afia Serwah Asare Botwe, was about to adjourn the case for two weeks, the Attorney General's representative, Principal State Attorney Richard Gymbiby, announced the intention to file a Nolle Prosiqui to drop charges against Dr. Anemana. This action would result in the dismissal of all charges against him.

Dr. Ato Forson and Richard Dzakpa, the other defendants, were present during the proceedings.

Former Deputy Finance Minister, Dr. Cassiel Ato Forson, and businessman, Richard Jakpa will now be facing charges for causing financial loss to the state over the importation of 200 ambulances in a contract between the Ministry of Health and a Dubai-based company, Big Sea Limited in 2012.

They are charged with five counts of willfully causing financial loss to the state, abetment to willfully cause financial loss to the state, contravention of the Public Procurement Act and intentionally misapplying public property, and have all pleaded not guilty to the charges.
