A lawyer and family life counselor, Kweku Yamoah Paintsil has revealed that a man can go to court to get an order to compel a woman from still using his name after the dissolution of their marriage.

According to the legal practitioner, such a practice amount to the jactitation of marriage.

“Let me tell you something interesting. Even when a marriage has been dissolved. You get a divorce from Mr.Paintsil and you are still using Mrs. Paintsil, I can go to court. There is what we call jactitation of marriage. I can get an order of the court to compel you to stop using my name,” he noted.

“And I have always said that If my wife dares divorce me, she is not going to have the privilege of using Mrs. Paintsil and that is the way it goes, like me, like my dog,” he added.

Speaking on Home Affairs on JoyFM, he further bemoaned the fact that people walk out of a marriage and they think that is the end of it and do not give credence to certain consequences.

Furthermore, Lawyer Paintsil stated that the sole ground for presenting a petition for divorce is the fact that the marriage has broken down beyond reconciliation.

He however indicated five requirements for proving that the marriage has broken down beyond reconciliation.

They include adultery, unreasonable behavior, desertion, separation, and where the parties have not lived together as husband and wife for 5 years.

“The law has specified specific grounds upon which the parties can part company to dissolve the marriage and the sole ground for presenting a petition under our laws is the marriage has broken down beyond reconciliation,” he indicated.

“But for purposes of proving that the marriage has broken down beyond reconciliation, there are five grounds that the law is looking for. What it means is that if you want a divorce, then you must be able to fix whatever your challenge or problem is, under any one of the five grounds,” he ended.
