After a hung jury: Lawyers to apply for Afoko’s bail, Asabke sentenced to death

Lawyers for Gregory Afoko are set to apply for bail for their client after his trial at the Accra High Court ended with a hung jury today.

However, Asabke, a conspirator was unanimously found guilty of the offense by the seven-member jury and has thus bound to serve a death sentence.

Lawyer Nana Yaw Osei, counsel for Gregory has meanwhile welcomed the decision and told Dennislaw news that his side will apply for bail for their client after being in custody for the last eight (8) years.

In court today, the presiding judge summed up the evidence in about four hours after which the jury retired following which they entered 4:3 in favor of Gregory Afoko and a unanimous verdict for Asanbke making him liable for the full punishment for the offense per the law.

Hung Jury

By the 4: 3 decision, the jury stands discharged, and thus per Section 286 of the Criminal and Other Offences (Procedure) Act, 1960(Act 30), whenever the jury is discharged, the accused person shall be detained in custody or released on bail and shall be tried by another jury.

Gregory Afoko has been in police/prison custody for almost eight years after being arrested in 2015 in connection with the murder of the then Upper East Regional Chairman of the New Patriotic Party(NPP), Alhaji Adams Mahama.

This followed severe bodily injuries suffered by the deceased after a substance suspected to be acid was allegedly poured on him around 11 pm on May 20, 2015, and later passed on at the Bolgatanga General Hospital.

The two were thus charged with conspiracy to commit murder and have since pleaded not guilty to the charges.
