A guide to practising Commercial Arbitration in Ghana: New book by Lawyer Bobby Banson

In Ghana, it's not very common to find text on arbitration practice, unlike the other areas of law. This is not quite surprising as arbitration in itself seems like an evolving area of practice. 

Aside from the lead taken by Professor Richard Oppong, Justices Sir Dennis Dominic Adjei, Frances Barbara Ackah-Yensu, Stephen  A. Brobbey, and Victor Brobbey in the area of Alternative Dispute Resolution, it appears there isn't much written material, particularly in the area of Comercial Arbitration practice. 

That notwithstanding, there's a new addition to the counting few. Lawyer Bobby Banson has been putting together reference material on the practice of commercial arbitration in Ghana. 

The book essentially discusses how arbitral proceedings should be conducted before a tribunal by the arbitrator and the parties from the start of the proceedings to the end of the proceedings. 

The text of 5 chapters also explore the legal history, regime, and framework for arbitration in Ghana; the procedures involved in commencing and participating in a commercial arbitration; the rights and conduct of parties during proceedings and the options open to the parties following the delivery of an arbitral award, as well as insight into the precepts that must guide drafting effective arbitration clauses. 

“This book, is an easy and useful guide to lawyers and non-lawyers, on commercial arbitration practice in Ghana. It is written in simple, straightforward language to make it easy for readers to understand the basic tenets of commercial arbitration in Ghana,” Sir Sam Jonah writes in the Foreword.

But it's also important to note that deciding to write reference material for this area of law might have seemed like an easy choice, as the author has been involved in arbitration practice for the last eight years.

As a Fellow of the Chartered Institute of Arbitrations, UK, and a founding member of the steering committee of the Ghana Chapter of the Chartered Institute of Arbitrators (Ciarb), Bobby Banson has acted as Counsel in arbitrations before the International Chamber of Commerce (ICC), the Permanent Court of Arbitration (PCA) and the Court of Arbitration for Sports (CAS) as well as the Ghana Arbitration Center. 

At his law firm, the Robert Smith Law Group, he heads the firm's practice areas in Alternative Dispute Resolution, Investment Advice, and Corporate Governance. 

His new book is set to be officially launched on Wednesday, March 6, 2024, at the Movenpick Ambassador's Hotel.
