“Fix-the-country” protesters object AG representation in court

The Criminal Court 1 Division of the High Court heard by Justice Ruby Aryeetey has been urged by lawyers of the organizers of the “Fix-the-country” protest, to remove the Attorney General from the case.

Before the Attorney General, Godfred Yeboah Dame could move a motion for an injunction on the intended protests by the “fix-the-country” protesters, a lawyer for the conveners, Julius Asinyo objected; the capacity of the Republic to institute proceedings; the processes that invoked the Court’s jurisdiction and; a further matter of whether the Attorney General was properly clothed with constitutional backing to represent the Police in the matter.

The lawyers argued that the civil nature of the case meant that the proceedings ought to have been instituted and led by the Police, instead of the AG.

In his response, however, the Attorney General argued that the objections raised were improperly grounded and borne out of a misunderstanding of the basic laws guiding said application.

He observed that the Police Service is recognized by the Constitution as a public service, hence, can enjoy the legal representation of the Attorney General.

The High Court will reconvene on Friday, 25th June 2021 for the ruling of Justice Ruby Aryeetey on this preliminary objection.
