A Deputy Attorney General Designate, Miss Diana Asonaba Dappah has indicated that the law on the deportation of foreigners is clear on how foreigners who engage in illegal mining should be dealt with.

3 persons were this week jailed 45 years and fined a sum of GH¢720,000for undertaking small-scale mining operations without a license.
The three convicts, Joseph Donkor, 40, Joseph Paul, 27, and Charles Ewusi, 27, were each jailed 15years on two counts of mining without license and conspiracy to commit a crime. In addition, they were fined ¢240,000.00 each.
The convicts were caught in the act of illegally prospecting for gold in a forest reserve on February 16 during an operation by a team from the Regional Forestry Commission.
Furthermore, a Kumasi High Court has convicted four Chinese nationals for their involvement in illegal mining activities on a 40-acre land of Obuasi-based Seidu Fanzia School.
However, Shi Li Wen, Huang Shen Jun, Li DeHao, and Lan Hai Song are to be deported for illegal residence, using fraudulent means to validate their residence and working without the required permits.
“The four Chinese citizens who have all violated sections 23(1) and 35(1, d) of the Immigration Act 2000 (Act 573) of Ghana, found working by prospecting for gold on the disputed site at Obuasi, are to be deported to their country of origin by this court and are hereby deported,” said the Presiding judge.
In her response to the case of deportation, she indicated that the law is clear as to the kind of punishment meted to any person who breaches the country’s minerals and mining Act.
“I believe that the Law is clear that any person, foreigner who is found to be in breach of our minerals and mining act shall serve the full term before any possible deportation,” she said.
She was responding to a question on the position of the law on the deportation of criminals.
