The Supreme Court has scheduled Wednesday, April 16, 2025, to commence proceedings on an injunction application challenging President John Dramani Mahama’s decision to initiate steps that could lead to the removal of Chief Justice Gertrude Torkornoo.

This follows a legal action filed on March 27, 2025, by Vincent Ekow Assafuah, Member of Parliament for Tafo in the Ashanti Region. 

The Supreme Court had initially adjourned the case indefinitely on April 5, citing a national training exercise involving state attorneys.

The MP has dragged the Attorney General to court, alleging that the President breached several constitutional provisions when he forwarded three petitions seeking the Chief Justice’s removal to the Council of State—without first informing the Chief Justice or allowing her to respond.

Assafuah contends that this action violates key provisions under Article 146 of the 1992 Constitution, particularly those that safeguard the independence and tenure of office of the Chief Justice. He argues that proceeding without notifying the Chief Justice undermines the constitutional process and her right to a fair hearing.
