Supreme Court rejects Dame’s withdrawal from Torkornoo case
A seven-member panel, chaired by Justice Amadu Tanko, said there was nothing before the court to show that Justice Torkornoo had been served with the notice filed by her lawyers.
The Supreme Court has rejected a request by former Attorney-General Godfred Yeboah Dame to withdraw as lawyer for former Chief Justice Gertrude Sackey Torkornoo.
The court described the notice of withdrawal as defective.
A seven-member panel, chaired by Justice Amadu Tanko, said there was nothing before the court to show that Justice Torkornoo had been served with the notice filed by her lawyers.
Because of the public interest in the matter, the court adopted the processes already filed on her behalf by the former Attorney-General.
The Registrar of the Supreme Court has been directed to serve Justice Torkornoo with the proceedings of the day and the withdrawal notice.
The court said if she wishes to file any further processes after being served, she must do so before July 2, 2026.
That date has been fixed for judgment in the constitutional cases challenging the processes that led to her suspension and subsequent removal as Chief Justice.
The Supreme Court is dealing with four separate actions connected to the matter.
Those cases have now been consolidated into two.
Justice Torkornoo’s own case, numbered J1/22/2025, has been joined with the case filed by the Centre for Citizenship, Constitutional and Electoral Systems LBG, numbered J1/21/2025.
Another action filed by Old Tafo MP Vincent Ekow Assafuah, numbered J1/18/2025, has also been consolidated with the case filed by Theodore Kofi Atta Quartey, numbered J1/20/2025.
The court said all proposed memoranda of issues filed separately by the parties have been adopted.
The panel hearing the case includes Justices Amadu Tanko, Emmanuel Yonny Kulendi, Henry Anthony Kwofie, Senyo Dzamefe, Sir Dominic Denis Adjei, Hafisata Amaleboba and Kweku Tawiah Ackaah-Boafo.
Judgment is expected on July 2, 2026.
