Supreme Court clears Akwatia MP of contempt
The 5-member panel of the apex court sitting on June 11, also annulled the bench warrant issued by the Koforidua High Court for Mr Kumi's arrest.
The Supreme Court has quashed the conviction of Ernest Yaw Kumi, the Member of Parliament for Akwatia, who was earlier found guilty of contempt by the Koforidua High Court.
This landmark decision, delivered on Wednesday, June 11, also annulled the bench warrant issued for Mr. Kumi’s arrest by Justice Emmanuel Senyo Amadehe, effectively halting any further sentencing processes related to the contempt case.
In a 4–1 majority ruling, the apex court held that the High Court's actions were untenable, and as such, Mr. Kumi could not be subjected to sentencing. The majority panel included Justices Henrietta Mensa-Bonsu, Ernest Gaewu, Henry Kwofi, and Adjei Frimpong. The lone dissenting voice was Justice Gabriel Scott Pwamang, who presided over the panel.
This decision brings a dramatic end to weeks of legal tension surrounding the MP’s contempt proceedings, which had sparked public debate over judicial discretion and legislative immunity.
