NDC Nsawam -Adoagyiri PC files suit, wants court to order fresh election

Amid disputes causing delays in the collation of parliamentary election results in certain constituencies, Amenorpe Philbert Fummey, the National Democratic Congress (NDC) parliamentary candidate for Nsawam Adoagyiri in the Eastern Region, has filed a lawsuit against the Electoral Commission (EC), seeking a re-run of the election in the constituency.

The writ, which also names Frank Annoh Dompreh, the New Patriotic Party (NPP) parliamentary candidate, as a defendant, accuses the EC of using invalid result sheets, known as pink sheets, in the collation process.

Filed at the Accra High Court on Friday, December 13, by Mr. Fummey’s legal counsel, Godwin Edudzi Kudzo Tameklo, who is also the NDC’s Director of Legal Affairs, the suit is accompanied by a motion for an interlocutory injunction. The motion seeks to halt further collation of results until the court resolves the primary case.

According to Mr. Fummey, members allegedly affiliated with the NPP attacked the collation center, leading to the destruction of some pink sheets. He claims that, prior to the attack, his team had collated results from 118 out of 203 pink sheets, but following the incident, they were left with only 137 sheets. Meanwhile, the EC reportedly informed him that it had 80% of the pink sheets in its possession.

Despite the alleged destruction, Mr. Fummey states that the EC proceeded with the collation process. He expressed surprise that the EC, which initially admitted to incomplete documentation, later insisted it had all the necessary pink sheets and summoned stakeholders to resume and complete the collation.

Mr. Fummey argues that the election’s integrity in Nsawam Adoagyiri has been compromised due to the "absence, incompleteness, and questionable authenticity" of the pink sheets. He is seeking a court declaration to confirm that the EC cannot announce a winner for the parliamentary election under these circumstances.

Additionally, he requests the court to mandate fresh elections in the constituency to ensure fairness and transparency.
