ICJ to deliver Order on provisional measures sought by Ukraine against Russia on March 16

Together with the application, Ukraine filed a request for the indication of provisional measures, pursuant to Article 41 of the Statute of the Court and Articles 73, 74 and 75 of the Rules of Court, in which it requests the Court to indicate provisional measures “in order to prevent irreparable prejudice to the rights of Ukraine and its people and to avoid aggravating or extending the dispute between the parties under the Genocide Convention”.

The International Court of Justice (ICJ) will on Wednesday, March 16, 2022, deliver its order regarding a request for the indication of provisional measures submitted by Ukraine in an application concerning allegations of genocide against Russia.

Ukraine on February 27, 2022, filed an application contending among other things that, Russia has no lawful basis to take action against Ukraine for the purpose of preventing and punishing any purported acts of genocide in the Luhansk and Donetsk oblasts of Ukraine.

In the application also, Ukraine accused Russia of “planning acts of genocide in Ukraine” and contended that Russia “is intentionally killing and inflicting serious injury on Ukrainians.

Ukraine is therefore seeking the Court’s jurisdiction on Article 36, paragraph 1, of the Statute of the Court and on Article IX of the Genocide Convention, to which both States are parties.

A press release from the UN Court on March 14, 2022, said the sitting would be streamed live and on-demand (VOD) in English and in French on the Court’s website and on UN Web TV.

“A public sitting will take place at 4 p.m. at the Peace Palace in The Hague, during which the President of the Court, Judge Joan E. Donoghue, will read out the Court’s Order,” the statement announced.
