Gyakye Quayson’s criminal case: High Court dismisses motion to strike out 3 charges

The High Court, Accra has dismissed a motion filed by the embattled Assin North MP, James Gyakyie Quayson to strike out 3 of the 5 charges leveled against him by the state in the case.

In February this year, the MP was charged by the state with five counts of perjury and forgery of passport with the specific charges being; deceit of public officer, forgery of a passport, knowingly making a false statutory declaration, perjury, and false declaration. 

He pleaded not guilty to all the charges and was granted bail to the tune of GHc 100,000.

However, per the motion filed by his counsel, Tsatsu Tsikata, he notes that the 3rd to 5th charges bothered Article 94(2) of the Constitution which is a matter for interpretation by the Supreme Court.

Further to the above, counsel noted on Wednesday, May 1, 2022, that the three(3) charges did not meet the threshold per Article 19(11) which required sufficient particulars of an offense to be provided.

On its part, the Office of the Attorney General represented by state Attorney, Dorcas Feli opposed the motion indicating that the charges had properly been provided for under the statutes.

Also, she disagreed with the argument to the effect that sufficient information had not been provided to the accused relative to the charges.

Moreover, she indicated that Mr. Quayson’s right to a fair trial would not be violated in any way if the trial proceeds thus describing the motion as an attempt to waste the court’s time.

The presiding judge while upholding the AG’s position, indicated that the motion is without merit and thus dismissed the same.

The case has meanwhile been adjourned to July 12 for the state to call its first witness.
