ECOWAS Court orders AG to file additional documents by March 28, pay $750

The court presided over by Edward Amoako Asante declined the AG's request and described the reason for its late response as untenable and ordered the same to pay an amount of $750 to Transparency International.

The ECOWAS Community Court of Justice has ordered the Attorney General of Ghana to file all additional documents by March 28, in the case brought against it by Transparency International.

Additionally, the AG’s outfit is to pay an amount of $750 for the late filing of its defense in the case.

Transparency International has filed a suit at the ECOWAS Court seeking its intervention to halt the Agyapa deal. 

According to the International NGO, the deal which seeks to monetize Ghana’s natural resource(gold) is politically skewed due to the interests and involvement of Politicians.

The External Court session of the Community Court of Justice of the ECOWAS is being held in Ghana for the first time since its formation; under the auspices of the Judiciary of Ghana from March 20 to April 2, 2022.

Ghana’s President, H.E. Nana Akufo-Addo who is Chair of the Authority of Heads of State and Government of the ECOWAS opened this external Court session on Monday, March 21, 2022, at the 5th Floor of the Law Courts Complex in Accra.

During the Court’s proceedings on March 23, Chief State Attorney, Dorthy Afriyie Ansah prayed the court to allow the AG to file its defense because she was taken ill by complications culminating from the deadly COVID 19.

The court thus acceded to the AG’s request and duly adopted the same.

Moreover, the Chief State Attorney impressed on the Court to also give the AG an additional time to file its response to Transparency International’s response to its proposed defense.

It was on this request that the court presided over by Edward Amoako Asante declined and described the AG’s reason for its late response as untenable and ordered the same to pay an amount of $750 to Transparency International.

The Attorney General has additionally been ordered to file all additional documents by March 28, 2022, to enable the case to be held on Wednesday, March 30.

Community Court of Justice, ECOWAS-External Session

The External Court session of the Court is being held in Ghana for the first time since its formation over twenty years ago.

The session, which is important in the annual work program of the Court, is anchored on the provision of Article 26(2) of the 1991 Protocol on the Court.

It is aimed at bringing Justice to the average person at the grassroots of the Community.

The Programme also provides the opportunity for Judicial dialogue with the national Courts of host countries and exposes lawyers and community citizens in the country to the practice and procedure of a Regional International Court.
