Court strikes out TDC’s case in Nii Tetteh Santeo family land dispute

TDC Ghana Limited has suffered a major setback in the High Court after its defence and counterclaim were both struck out in a land dispute involving the Nii Tetteh Santeo family.

The decision, delivered by Justice William Boampong at the Land Division of the High Court in Accra on Thursday, 23 April 2026, also came with a cost order of GH¢10,000 against the state-owned company.

The case arises from a suit brought by representatives of the Nii Tetteh Santeo family over a 361-acre parcel of land. Also named in the action are Trasacco Estates Development Company Limited and the Lands Commission.

At the centre of TDC’s position was its claim that it had leased the land to Trasacco under a barter arrangement tied to infrastructure works.

But that defence ran into difficulty after the court, in July 2025, directed TDC to produce documents backing the transaction. Those documents included the underlying infrastructure contract, proof that the TDC Board had approved the arrangement, and evidence of approval from EOCO after what was described as an investigation.

According to the court record, TDC did not comply with that order.

That failure prompted counsel for the plaintiffs, Tsatsu Tsikata, to ask the court to strike out the company’s defence and enter judgment in favour of the family.

The court agreed, bringing TDC’s part of the case to a decisive halt by removing both its defence and its counterclaim from the proceedings.

The matter is not entirely over, however. The case against the other two defendants, Trasacco Estates Development Company Limited and the Lands Commission, remains alive and has been adjourned to 15 June 2026 for further hearing.
