A High Court in Accra has dismissed a lawsuit seeking to stop the Electoral Commission from recognising the NDC’s candidate for the Ayawaso East by-election, clearing the way for voting on Tuesday, 3 March 2026.

The case was filed by the pressure group Democracy Hub, which accused the NDC’s parliamentary primary of being tainted by vote buying and asked the court to restrain the EC from acting on Baba Jamal’s nomination.

But the NDC raised a preliminary objection, arguing the action was defective and the applicants lacked proper standing. The judge, Justice Agyenim-Boateng, upheld that objection and struck out the suit as “incompetent”, ending the case without considering the substance of the allegations.

The court decision comes after the NDC carried out its own internal review of the primary and maintained Baba Jamal’s candidature, citing party rules and the EC’s nomination timelines.
