Atimpoku 'contaminated fuel' incident: Edmund Barwuah sues Vivo Energy for negligence

Vivo Energy Ghana Limited has been sued for negligence relative to the alleged selling of water-mixed fuel at its Shell Fuel Station at Atimpoku in the Eastern Region.

According to the suit filed by Edward Barwuah and signed by counsel, Dela Blagogee of Blagogee Blacksword and Co, the plaintiff notes that the Company owed him and others a duty of care to ensure that its fuel meets the highest standards required.

The plaintiff notes further that he was one of the many persons who purchased on August 28, 2022, fuel contaminated with water at the said Shell fuel Station before the closure of the same by the regulator.

Even though the Company has come out to explain the circumstances which led to the fuel contamination and rendered an unqualified apology, the plaintiff indicates that Vivo Energy valued profit over human lives when it fuelled his 2017 Ford Explorer Vehicle with contaminated fuel.

As a result of the above, the plaintiff further avers that after driving about a kilometer in the car with his friend, the car experienced jolting and extreme violence which made them suffer shock, fear, and panic.

Additionally, it is the case of the plaintiff that the real possibility of an accident experienced by them coupled with the resultant injury and possible death has heightened their fear.

He thus avers per the above that Vivo Energy knew that the fuel product it was selling to the public including him, was contaminated and mixed with water but went ahead and put their lives at risk by selling the same.

As a result of the happening, the plaintiff states that he missed a business meeting culminating in losing an opportunity worth $2.5 million.

He is therefore praying the court for among other things;

Special damages of $2.5 million

An order directed at the defendant to replace his 2017 Ford Explorer with a vehicle of the same specification

Damages of GHC 600.00 daily for the loss of the use of his car starting from the day of the incident.
