AG ordered to disclose additional documents in Hanan Abdul-Wahab trial

The prosecution in the criminal trial of former National Food Buffer Stock Company Chief Executive Officer, Hanan Abdul-Wahab Aludiba, has been ordered to hand over any additional documents relevant to the case.

Justice Francis A. Achibonga of the Accra High Court, Criminal Division, Specialised Court 1, issued the order on Wednesday, July 29, 2026.

The ruling followed a defence application filed on behalf of the first accused by his lawyer, Richard Gyambiby.

The defence had complained that the Attorney-General had not disclosed all documents necessary for the accused person to properly prepare his case.

Counsel argued that withholding relevant materials could weaken the defence and affect the accused person’s constitutional right to a fair hearing.

The court agreed that the prosecution’s disclosure duty is not limited to documents it chooses to rely on during trial.

Justice Achibonga held that once any document is relevant to the charges and is in the possession or control of the Attorney-General, the Attorney-General’s Department or investigators working on the case, it must be made available to the accused.

The Attorney-General was therefore directed to disclose all such materials to the first accused.

Mr Abdul-Wahab Aludiba is facing charges arising from his time as CEO of NAFCO.

The charges include stealing, defrauding by false pretences, causing financial loss to the State and money laundering.

The court’s decision places renewed emphasis on the prosecution’s obligation to ensure that an accused person has access to relevant material before trial proceeds.

That obligation, the ruling suggests, applies whether the material helps the prosecution or assists the defence.

The case has been adjourned to July 30, 2026.

On that date, the court is expected to consider another application by the first accused seeking to stay the proceedings until an appeal is determined.
